VASP & CASP FAQ

The questions crypto founders and compliance teams ask us most before applying for a licence.

Any person or entity that professionally accepts or holds crypto assets for third parties, or that transfers them, must either affiliate with a FINMA-recognised SRO or obtain a FINMA licence. If you operate a Swiss exchange, wallet service or brokerage — even as part of a wider product — you almost certainly require registration. We conduct a rapid eligibility assessment to confirm your position and identify the fastest compliant path.

The EU Markets in Crypto-Assets Regulation (MiCA) creates a new Crypto-Asset Service Provider (CASP) licence for any firm providing crypto services — exchange, brokerage, custody, transfer, portfolio management — to EU clients. If you serve EU retail or professional clients from any jurisdiction, MiCA likely applies. Our team maps your specific services to MiCA's ten activity types and advises on the most efficient home-member-state application.

Typically two to four months from submission of a complete dossier, depending on the SRO and the complexity of your AML programme. Our structured process — gap analysis, AML programme design, AMLO appointment and application drafting — ensures your submission is complete and materially accurate, minimising back-and-forth with the SRO.

The core package includes a regulatory gap analysis memorandum, AML/KYC programme (internal directives, risk appetite, transaction-monitoring rules), AMLO appointment letter, business model description, beneficial-owner declaration and the SRO or NCA application form. For MiCA, this extends to a programme of operations, governance description and capital adequacy evidence. Everything is tailored to your business — not a generic template.

Yes. German crypto custody businesses (Kryptoverwahrgeschäft) require BaFin authorisation or, in transitional cases, notification. Our Berlin-based team advises on the notification pathway, prepares the required documentation and manages the BaFin dialogue alongside any parallel Swiss or MiCA process.

Absolutely — and we strongly recommend it. The regulatory treatment of your token (utility, payment or security under Swiss law; asset-referenced, e-money or utility under MiCA) determines which licence you need, which disclosure rules apply and how you can market to investors. Our Token Assessment produces a written legal opinion you can rely on and share with exchanges, investors and regulators.

The kick-off workshop is a flat fee of CHF 3'800 (excl. VAT). Turnaround is 3–5 business days covering preparation, the 2-hour workshop with our legal, regulatory and tax experts, and a debriefing. You leave with a written action plan setting out next steps, timelines and fee estimates.
